What you agree to when you buy pixels.

1. 1Who we arePaint of Society is operated by Apeka Group Limited, a company registered in England and Wales, company number 17105369, registered office 66 Paul Street, London EC2A 4NA, United Kingdom. Questions and complaints: hello@paintofsociety.com. These terms are the contract between you and us when you use the site or buy pixels.
2. 2What a pixel isA pixel is a one-time, personal right to paint one square of the shared 1,000 x 1,000 canvas and to have your design and optional message displayed there permanently, plus a commemorative certificate. It is a digital product. It is not an investment, a security, a share, or a financial product of any kind: you receive no money, no resale value, and no financial return, and you should not expect any.
3. 3Price and paymentEach pixel costs exactly $1. The price is all-inclusive: there are no additional fees or surcharges. Payment is taken by our payment provider Stripe; we never see your full card details. Your bank may apply its own currency conversion if your card is not in US dollars.
4. 4One design, locked foreverBuying a pixel gives you the right to paint it once. Your design and message are locked at purchase and become a permanent part of the artwork. Pixels cannot be repainted, transferred, gifted, or resold, and your account is personal to you.
5. 5Your 14-day withdrawal rightUK and EU consumers normally have 14 days to cancel a digital purchase. Because your design is placed on the shared canvas immediately, we only sell with your express consent to immediate supply and your acknowledgement that you lose the 14-day right of withdrawal once supply has begun. You give both at checkout by ticking a box that is never pre-ticked, and we confirm them by email. Once your pixels are painted, the purchase is final and non-refundable, except where the law says otherwise.
6. 6Your licence to usYou keep the copyright in the design and message you submit. So that the shared artwork can exist, be displayed, promoted, and one day be sold as a whole, you grant us a worldwide, perpetual, irrevocable, royalty-free, transferable and sub-licensable licence to host, store, reproduce, adapt (only as needed to display and reproduce it), publish, display, and communicate your contribution as part of the canvas and the finished artwork, to use it to promote Paint of Society, and to pass these rights on to the auction buyer and the receiving charity. This licence survives the closure of your account.
7. 7Moral rightsTo the extent permitted by law (section 87 of the UK Copyright, Designs and Patents Act 1988), you unconditionally and irrevocably waive your moral rights in your contribution, including the right to be identified as its author and the right to object to how it is treated as part of the collective artwork. A million-pixel collective work cannot credit each contributor or seek approval for how contributions appear together.
8. 8Your promises about your contentYou promise that you created your design and message or hold all rights needed to grant the licence above, that your content does not infringe anyone's copyright, trademark, privacy, or other rights, and that it is not illegal. If we suffer loss because this promise is untrue, you agree to compensate us for reasonable, foreseeable losses caused by your breach. This does not apply where you acted with reasonable care, and nothing in this section limits your statutory rights as a consumer.
9. 9Content rulesYou must not submit content that is illegal in the UK or in your country, including content that promotes terrorism, sexually exploits or endangers children, is pornographic or sexually explicit, incites hatred or violence, harasses, threatens, or defames a person, promotes fraud or scams, or infringes someone else's intellectual property. We may screen designs before or after they appear and may refuse or remove any content that breaks these rules.
10. 10Reporting, removal, and appealsAnyone can report a design or message using the Report button on any pixel or by emailing hello@paintofsociety.com. We review every report and remove content that is illegal or breaks these terms. If your content is removed, the pixels remain yours on the canvas, but the design is cleared and no refund is given. If you think we made a mistake, whether by removing your content or by not acting on your report, write to hello@paintofsociety.com and we will review the decision again.
11. 11The auction and charityWhen 100% of the canvas is claimed, we will offer the finished artwork for sale at auction to a single collector. 100% of the net auction proceeds (after auction and transaction costs) will be donated to a charity chosen by a vote of pixel owners (one pixel equals one vote) from a published shortlist of registered charities. Pixel owners receive no part of the proceeds. The canvas may never reach 100%, and we cannot guarantee that an auction will take place or that any particular price will be reached. Permanent display means for the lifetime of the project: if we ever had to end the service before the canvas is complete, we would give notice on the site and keep a public archive of the canvas and certificates for as long as reasonably practicable.
12. 12Your accountYou must be at least 18 to buy pixels. Keep your login details safe; you are responsible for activity on your account. We may suspend or close accounts that break these terms or abuse the service. Closing your account does not remove your painted pixels from the canvas; see the Privacy Policy for how we unlink your identity on request.
13. 13Our liabilityNothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be excluded under UK law, and nothing affects your statutory rights as a consumer, including the right to digital content that is as described and of satisfactory quality. Beyond that, we are not liable for losses that were not foreseeable to both of us when the contract was made, and our total liability to you is limited to the amount you paid us.
14. 14Changes, language, and lawWe may update these terms; the version in force when you buy applies to that purchase, and updated versions are posted on this page with a new version date. These terms are written in English and translated for convenience; if a translation conflicts with the English text, the English text prevails. These terms are governed by the laws of England and Wales and disputes go to the courts of England and Wales; if you are a consumer, you also keep the mandatory protections and courts of the country where you live. Purchases are not available in the United States.
